Determining if you are eligible for benefits

  1. Will you be out of work for 12 Months?

    • You must be out of work or expect to be out of work for one full year.
    • If you are working and your gross earnings average more than $1,550 each month, you will not be eligible for benefits.

  2. Does your disability significantly limit your ability to work?

    Your medical condition must be severe enough to limit your ability to do basic work activities.  Examples of this would be having difficulty with standing, walking or sitting.  Your disability must be expected to last for at least one full year. 

  3. Is your medical condition described in the List of Impairments?
    A List of Impairments details various medical conditions that are so severe that the Social Security Administration may automatically find that you are disabled as defined by law. If your disabling medical condition or combination of medical conditions is not on this list, the Social Security Administration looks to see if your disabling condition is as severe as a medical condition that is on the list. If the severity of your medical condition meets or is as severe as another impairment on the list, the Social Security Administration may then approve you for benefits.

  4. Are you able to do the work you did before?
    Does your medical condition prevent you from being able to do the work you did before. If it does not, you will not be eligible for benefits.

  5. Are you able to do any other type of work?
    Your medical condition, your age, education, past work experience and any skills you may have that could be used to do other work will be evaluated. If you have been treating with a doctor and you are not capable of doing other work, you could be considered disabled and eligible for benefits. If you can do other work, you will not be eligible for benefits.

Note: You must also be younger than 65 years old to qualify for Social Security Disability Insurance. You may qualify for Supplemental Security Income if you are age 65 or older.
